It should be read together with our Terms & Conditions, Cookie Policy, Shipping Policy, and Returns, Refunds & Cancellations Policy.

Where consent is required by applicable law, we will request consent before conducting the applicable processing.

  • Information submitted through contact forms, privacy-request forms, opt-out tools, or other Site features; and
  • Any other information you voluntarily provide.

Please do not provide sensitive personal information that we have not requested.

2.2 Information collected automatically

When you use the Site, we, Shopify, Google, and other service providers may automatically collect Site activity information, a term used throughout this policy to mean:

  • IP address and approximate location derived from it;
  • Browser, device, and operating-system type and settings, including language, screen resolution, and time zone;
  • Device, browser, cookie, advertising, session, or other online identifiers;
  • Pages, products, and content viewed, and searches performed on the Site;

  • Error, security, fraud-prevention, and diagnostic information; and
  • Information collected through cookies, pixels, tags, local storage, customer-event technologies, software-development kits, and similar technologies where enabled.

Some of this is collected only when particular analytics, advertising, personalization, measurement, or ecommerce features are enabled and, where required, after you provide consent.

2.3 Payment information

Payments are processed through PayPal and the PayPal-supported options displayed during checkout, which depending on availability and eligibility may include PayPal, Venmo, eligible credit or debit cards, bank-funded payments, or other methods made available through PayPal.

We do not intend to receive or independently store your complete payment-card number, card security code, complete bank-account credentials, PayPal password, or Venmo password. Payment providers process payment and transaction information under their own privacy policies, security practices, and terms.

3. SOURCES OF PERSONAL INFORMATION

We may collect personal information directly from you; automatically from your browser or device; from Shopify, which hosts and operates the Site; from PayPal, Venmo, and other supported payment providers; from USPS, UPS, FedEx, and other shipping or delivery providers; from Google services when enabled, including the Google & YouTube sales channel, Google Merchant Center, Google Ads, Google Analytics, Google tags, and YouTube Shopping; from fraud-prevention, cybersecurity, identity-verification, and account-verification providers; from analytics, advertising, conversion-measurement, and marketing providers when enabled; from email and communication service providers; from social-media platforms and referral sources when you interact with us through them; from professional advisers, law-enforcement agencies, regulators, government authorities, and other lawful sources; and from other sources where you direct or authorize information to be provided to us.

4. HOW WE USE PERSONAL INFORMATION

To fulfill orders and serve customers: process payments and complete purchases; fulfill, package, ship, and deliver orders; send order confirmations, shipping notices, delivery updates, and tracking information; create and maintain optional customer accounts; authenticate customers and protect accounts; provide customer service and respond to inquiries; process cancellations, returns, refunds, replacements, and payment disputes.

To operate and secure the Site: detect, investigate, and prevent fraud, unauthorized transactions, security incidents, and misuse; secure, maintain, troubleshoot, and operate the Site; maintain shopping-cart and checkout functionality; remember customer settings and preferences.

To understand and improve: understand Site traffic, performance, and customer interactions; measure product views, searches, cart activity, checkout activity, purchases, and other ecommerce events where measurement services are enabled; improve our products, services, communications, and shopping experience.

For marketing and advertising, where enabled and permitted: measure advertising, campaign, conversion, and marketing performance; display, personalize, or evaluate advertising; create or measure advertising audiences, subject to applicable consent and opt-out choices; send promotional emails where permitted.

For legal and business obligations: maintain tax, accounting, payment, transaction, shipping, fraud-prevention, and business records; establish, exercise, or defend legal claims; enforce our Terms & Conditions and other policies; comply with legal obligations, lawful government requests, court orders, and regulatory requirements.

We may also use personal information for another purpose disclosed at or before the time of collection. We will provide additional notice or obtain consent before using personal information for a materially different purpose where required by applicable law.

5. HOW WE DISCLOSE PERSONAL INFORMATION

5.1 Shopify

The Site is hosted and operated using Shopify, which provides website hosting, cart and checkout functionality, order and inventory administration, customer accounts, fraud detection and security, email signup and communications, analytics, customer privacy tools, and other ecommerce and storefront functionality.

Shopify may process personal information on our behalf as a service provider or processor. Shopify may also process certain information for its own purposes in connection with Shopify consumer services, applications, advertising services, security services, personalization features, and other Shopify functionality.

Shopify Network Intelligence and Enhanced Services. When these are enabled, Shopify may process information about your interactions with the Site, with Shopify, and with other Shopify merchants, and may use it to provide, personalize, improve, secure, analyze, and advertise services, including features informed by customer interactions across our store, other merchants, and Shopify. Information may be shared with Shopify and service providers located in the United States or other countries. No other Shopify merchant is provided direct access to Styleup Innovation's individual customer records merely because Shopify Network Intelligence is enabled.

Shopify Consumer Privacy Policy: https://www.shopify.com/legal/privacy/consumers

Shopify Privacy Controls: https://privacy.shopify.com/en

Privacy requests concerning information controlled by Styleup Innovation should be submitted to us using the procedures in Section 12.

5.2 Google and YouTube

We use the Google & YouTube sales channel to connect our Shopify store with Google services, including Google Merchant Center. The channel may transmit or synchronize product-catalog, product-identifier, pricing, availability, shipping, return-policy, store, and business information with Google so that eligible products may appear in Google services.

Depending on the services and settings enabled, we may also use Google Ads, Google Analytics, Google tags, Google conversion measurement, Google customer-event integrations, YouTube Shopping, and related Google advertising, measurement, analytics, or ecommerce services.

Where these are enabled, Google tags or related customer-event technologies may collect or receive Site activity information as described in Section 2.2, together with product identifiers, order value and currency, transaction identifiers, advertisement interactions, conversion information, and consent and privacy-preference signals.

Google may use this information to provide analytics, measure advertising and conversions, report ecommerce activity, prevent fraud, improve services, personalize features, or support advertising where enabled and legally permitted. Advertising personalization and non-essential tracking are subject to our settings, your consent choices, and applicable law, and our Google tags may adjust their behavior based on consent choices transmitted through Shopify's customer-privacy tools or another properly integrated privacy tool.

Google independently processes certain information under its own policies: https://policies.google.com/privacy

5.3 Payment providers

PayPal, Venmo, and other supported payment providers receive information necessary to authorize and process payments, verify transactions, detect and prevent fraud, process refunds, resolve payment disputes, and provide customer payment services. They may independently control certain information under their own privacy policies and terms.

5.4 Shipping and delivery providers

We disclose shipping, order, and contact information to USPS, UPS, FedEx, or another carrier or delivery provider responsible for processing and delivering an order.

5.5 Communication providers

We may use Shopify or another provider to send order confirmations, shipping and tracking communications, return and refund communications, customer-service responses, account or security notices, and promotional emails where permitted.

5.6 Analytics, advertising, and marketing providers

Where enabled, these providers may receive Site activity information as described in Section 2.2, along with commercial information and consent and privacy-preference signals.

These services help us understand Site traffic and performance, measure advertising and marketing conversions, identify which advertisements or referrals led to visits or purchases, analyze customer interactions with products and the Site, prevent duplicate or fraudulent activity, improve our advertising and marketing, and — where enabled and permitted — create or measure advertising audiences and display advertising based on customer interests.

We may disclose information to accountants, attorneys, insurers, auditors, financial institutions, law-enforcement agencies, regulators, courts, government authorities, or other professional advisers when reasonably necessary and legally permitted.

Personal information may also be transferred or disclosed as part of a proposed or completed merger, financing, acquisition, reorganization, bankruptcy, asset sale, or sale of all or part of the business. We will provide notice of material changes where required by law.

6. SALE, SHARING, AND TARGETED ADVERTISING

We do not sell personal information in exchange for money.

Certain advertising, analytics, ecommerce, platform, audience, and Shopify Enhanced Services activities may nonetheless be defined as a "sale," "sharing," or processing for targeted advertising under some U.S. state privacy laws, even where we receive no money.

Depending on the services enabled, the information involved may include identifiers such as IP addresses, cookie, device, advertising, or email-derived identifiers; commercial information such as products viewed, placed in a cart, or purchased; internet or network activity such as pages visited, searches, clicks, and advertisement interactions; approximate location derived from an IP address; and inferences concerning interests or interactions.

Where required by applicable law, you may opt out of such activities conducted by or on behalf of Styleup Innovation. To do so, use the Your Privacy Choices link (also labelled "Do Not Sell or Share My Personal Information" or as a data-sharing opt-out) in the Site footer or privacy interface, or email support@styleupinnovation.com with the subject line Privacy Opt-Out Request.

You do not need to create an account or make a purchase to submit an opt-out request. An opt-out transmitted through a browser or device may apply only to that browser or device. To manage information processed independently by Shopify, visit https://privacy.shopify.com/en

Global Privacy Control signals are addressed in Section 8.

7. COOKIES AND SIMILAR TECHNOLOGIES

We and our partners, including Shopify and Google, may use cookies, pixels, tags, local storage, customer-event technologies, and similar technologies to operate and secure the Site, maintain cart and checkout functions, remember settings and preferences, authenticate customers, detect fraud and security threats, understand Site traffic and performance, measure ecommerce activity, and — where enabled and permitted — measure advertising, personalize content, and support advertising.

Some of these technologies are necessary for the Site to function. Others support analytics, personalization, advertising, conversion measurement, or audience creation depending on the services enabled. Where required by applicable law, we will not use non-essential technologies for analytics, personalization, or advertising without the required consent.

Where a cookie banner or privacy-preference tool is displayed, you may use it to manage available preferences. You may also block or delete cookies through your browser settings, though blocking necessary cookies may prevent cart, account, or checkout functions from operating correctly. Cookie and privacy choices may be associated with a particular browser or device, so you may need to repeat them elsewhere or after deleting cookies.

Full detail is in our Cookie Policy, available through the Site footer.

8. DO NOT TRACK AND GLOBAL PRIVACY CONTROL

Some browsers offer a traditional "Do Not Track" or "DNT" setting. Because there is no universally accepted standard governing how websites must interpret traditional DNT signals, the Site does not currently respond to them in a uniform manner.

Global Privacy Control ("GPC") is different from a traditional DNT signal. Where our configured Shopify customer-privacy tools or another properly integrated privacy tool recognize a GPC signal, we process it as an opt-out of applicable sale, sharing, or targeted-advertising activity where required by law. A GPC preference may apply only to the browser or device transmitting it.

Third parties, including Shopify, Google, and other analytics or advertising providers, may collect information about your online activities over time and across different websites or online services when their technologies are enabled, subject to applicable consent and opt-out requirements.

9. DATA RETENTION

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including applicable tax, accounting, fraud-prevention, chargeback, contractual, security, operational, and legal obligations.

Our general practices by record type:

  • Order and transaction records — retained as reasonably necessary to meet tax, accounting, fraud-prevention, chargeback, contractual, payment, and legal obligations;
  • Account information — retained while the account is active and for a reasonable period afterward, subject to legal, security, fraud-prevention, and operational requirements;
  • Marketing information — retained until you unsubscribe, withdraw consent where applicable, or the information is no longer reasonably needed;
  • Customer-support communications — retained as reasonably necessary to address the matter, maintain service records, prevent fraud, and resolve disputes;
  • Return and refund records — retained as necessary to process the request and meet accounting, fraud-prevention, chargeback, contractual, and legal requirements;
  • Analytics, advertising, and tag information — retained according to our configured settings, consent choices, and the applicable provider's retention controls;
  • Security records — retained as reasonably necessary to detect, investigate, document, and prevent security incidents or fraud; and
  • Privacy-request records — retained as reasonably necessary to document and respond to requests and demonstrate compliance.

When personal information is no longer reasonably needed, we delete, de-identify, aggregate, or securely dispose of it where reasonably practicable and legally permitted.

10. MARKETING COMMUNICATIONS

We may send promotional emails to individuals who subscribe or where otherwise permitted by law. You can unsubscribe by clicking the unsubscribe link in a promotional email or contacting support@styleupinnovation.com. We process marketing opt-out requests within the period required by applicable law.

Unsubscribing does not prevent us from sending necessary transactional, security, or service communications, such as order confirmations, shipping and tracking notices, delivery updates, return and refund communications, account or security notices, policy or service notices where appropriate, and responses to customer-support requests.

We do not currently offer marketing text messages. If that functionality is introduced, we will provide any required notices and obtain any consent required by applicable law before sending such messages.

11. YOUR PRIVACY RIGHTS AND CHOICES

11.1 Rights

Depending on where you live, whether the relevant law applies to Styleup Innovation, and subject to legal exceptions, you may have the right to:

  • Confirm whether we process your personal information;
  • Request access to your personal information, including specific pieces;
  • Request information about the categories of information collected, used, or disclosed;
  • Correct inaccurate personal information;
  • Request deletion of personal information;
  • Obtain a portable copy of certain information;
  • Opt out of the sale or sharing of personal information;
  • Opt out of targeted advertising or cross-context behavioral advertising;
  • Limit certain uses or disclosures of sensitive personal information;
  • Withdraw consent where processing is based on consent;
  • Appeal a decision concerning a privacy request; and
  • Receive equal service and pricing when exercising an applicable privacy right.

The availability and scope of these rights depend on applicable law. Legal exceptions may permit or require us to retain or continue using certain information, including for order completion, fraud prevention, security, accounting and tax compliance, dispute resolution, chargebacks, legal compliance, or establishing, exercising, or defending legal claims.

Where a particular privacy law does not apply, we may still consider reasonable access, correction, or deletion requests as a customer-service matter. We will not unlawfully discriminate against you for exercising an applicable privacy right.

11.2 Choices

You may manage available privacy choices by using the cookie banner or privacy-preference tool displayed on the Site; using the Your Privacy Choices link in the Site footer or privacy interface; activating Global Privacy Control in a supported browser or extension; or contacting support@styleupinnovation.com. Certain Shopify-controlled choices are available at https://privacy.shopify.com/en

Choices associated with cookies, browsers, or devices may need to be repeated on another browser or device or after deleting cookies.

12. SUBMITTING A PRIVACY REQUEST

Submit a request by email to support@styleupinnovation.com with the subject line Privacy Request, or by phone at +1 917-299-7143. For sale, sharing, or targeted-advertising opt-outs, you may also use the Your Privacy Choices feature available through the Site.

Please explain the request and provide the email address associated with your order, account, or previous interaction with us.

Identity verification.

We may need to verify that you are the person associated with the requested information, and may ask you to confirm information connected with your order, account, email address, shipping or billing details, or previous interactions with us. Do not send a government identification document unless we specifically request it through an appropriate and secure method.

Authorized agents.

Where permitted by law, an authorized agent may submit a request for you. We may request evidence of the agent's authority and may separately verify your identity before completing the request.

Response period.

We will respond within the period required by applicable law. Where a 45-day response period applies, we will generally respond within it. If applicable law permits an extension and additional time is reasonably necessary, we will notify you and explain the extension.

Appeals.

Where applicable law provides a right to appeal, email support@styleupinnovation.com with the subject line Privacy Appeal, explaining why you believe the original decision should be reconsidered. We will respond within the period required by applicable law.

13. CALIFORNIA PRIVACY DISCLOSURES

This section supplements the rest of this Privacy Policy for California residents.

CalOPPA.

The California Online Privacy Protection Act requires certain commercial websites and online services that collect personally identifiable information from California consumers to post a privacy policy describing their practices. The categories of information we collect, the purposes for which we use it, and the categories of third parties to whom it may be disclosed are described in Sections 2 through 5. California consumers may request access or correction under Section 12.

CCPA/CPRA.

The California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA"), applies only where its statutory requirements and business thresholds are satisfied. Where it applies to Styleup Innovation, California residents have the rights listed in Section 11.1, subject to applicable law and legal exceptions.

Categories of personal information

During the preceding 12 months, or since we began the relevant processing if shorter, we may have collected the following CCPA categories:

  • Identifiers — names, email addresses, postal addresses, telephone numbers, IP addresses, account identifiers, cookie identifiers, and device identifiers;
  • Customer-record information — contact, billing, shipping, account, and transaction information;
  • Commercial information — products viewed, products purchased, order history, returns, refunds, and shopping preferences;
  • Internet or electronic-network activity — browsing activity, product views, searches, cart and checkout activity, advertisement interactions, and interactions with the Site;
  • Approximate geolocation derived from an IP address;
  • Audio, electronic, visual, or similar information — photographs voluntarily submitted for customer service, damaged-item, return, or refund requests;
  • Professional or employment-related information — only where voluntarily provided in a business or professional communication;
  • Inferences derived from Site, product, transaction, or advertising interactions;
  • Sensitive personal information — such as account authentication or payment information, when processed by Shopify, PayPal, or another provider to complete transactions and protect accounts; and
  • Other information that identifies, relates to, describes, or could reasonably be associated with a consumer or household.

We do not intend to independently store complete payment-card numbers, card security codes, bank-account login credentials, PayPal passwords, or Venmo passwords, and we do not intend to use sensitive personal information to infer characteristics about an individual.

Sources, purposes, and disclosures

The categories of sources are described in Section 3. The business and commercial purposes for collecting, using, and disclosing personal information are described in Section 4. The categories of recipients to whom we disclose personal information for business purposes are described in Section 5, and include Shopify, payment providers, shipping and delivery providers, analytics and advertising providers, communication providers, security and fraud-prevention providers, professional advisers, government authorities, and business-transaction recipients. The specific disclosures depend on your interaction with the Site and the services enabled.

Categories that may be sold or shared

We do not sell personal information in exchange for money. Where advertising, analytics, Shopify Network Intelligence, audience, or similar services are enabled, the following categories may be considered sold or shared under the CCPA: identifiers, commercial information, internet or electronic-network activity, approximate geolocation, and inferences. The categories of third parties involved may include advertising, analytics, ecommerce-platform, and audience-service providers.

California residents may submit an opt-out request using the methods in Sections 6 and 12. We do not knowingly sell or share the personal information of consumers under 16 years of age.

Retention, agents, and non-discrimination

Retention practices are described in Section 9. Authorized agents may submit requests as described in Section 12. We will not unlawfully discriminate against a consumer for exercising a right provided by applicable California privacy law.

14. DATA SECURITY

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. These may include encryption during transmission, secure HTTPS connections, account and access controls, third-party payment processing, fraud-monitoring and risk-detection measures, reputable hosting and service providers, procedures intended to limit access to information, and procedures for reviewing and responding to security concerns.

No transmission method, storage method, website, checkout, or online system can be guaranteed completely secure. If a security incident requires notice under applicable law, we will provide the required notice to affected individuals, regulators, or authorities.

15. CHILDREN'S PRIVACY

The Site is a general-audience ecommerce store intended for adults. We do not knowingly collect personal information from children under 13, and the Site is not directed to children under 13. A person under the age of legal majority should use the Site or make a purchase only through a parent or legal guardian. We do not knowingly sell or share the personal information of consumers under 16 years of age.

If you believe a child submitted personal information to us without appropriate authorization, contact support@styleupinnovation.com. We will review the matter and take appropriate action, including deletion where required.

16. THIRD-PARTY WEBSITES AND SERVICES

The Site may contain links to or integrations with services operated by other companies, including Shopify, PayPal, Venmo, Google, YouTube, shipping carriers, advertising and analytics providers, communication providers, and social-media platforms.

Those companies control their own services and privacy practices. This Privacy Policy does not govern information that a third party independently collects, controls, or processes for its own purposes. Review the applicable third party's privacy policy before providing information directly to that service.

17. PROCESSING LOCATIONS

Styleup Innovation operates from the United States. Shopify, Google, PayPal, shipping carriers, and our other service providers may process, transfer, or store personal information in the United States and other jurisdictions in accordance with their terms, privacy practices, contractual commitments, and legal obligations.

We serve customers at eligible street addresses within the 48 contiguous United States and Washington, D.C., and do not currently offer international shipping. The Site may nonetheless be accessible from other countries. If you access it from another country, your information may be transferred to or processed in the United States or another jurisdiction where privacy laws may differ from those in your location.

This section does not limit rights provided by mandatory applicable law.

18. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy to reflect changes in our services, applications and integrations, vendors and service providers, technology, customer-privacy settings, advertising or analytics practices, legal obligations, or business operations.

The "Last Updated" date identifies the current version. We may provide additional notice or obtain consent for material changes where required by law. We encourage you to review this Privacy Policy periodically.
